AGF drags MTN to Federal High Court

The Federal High Court, Niger Judicial Division sitting in Minna has scheduled January 27 2017 to be­gin hearing on a case of violation of Nigeria Environmental Impact Assessment (NEIA) Act brought before it by the Attorney General and Chief Justice of the Fed­eration against MTN Ni­geria Communications Limited.
The complainant, rely­ing on Section 104 and 379 of the Administra­tion of Criminal Justice Act, 2015, averred that the defendant MTN, has constructed and installed mast without conducting and obtaining statement of approval of environ­mental impact assess­ment from the nations regulatory agency.
It mentioned a par­ticular offence of 20th November, 2013 where MTN constructed a base transmission station at No 1 Ibrahim Karya Av­enue, Chechenia Area, at Suleja, Niger State without carrying out an Environmental Im­pact Assessment Act (EIAA). The offence is contrary to Section 2 of the EIAA Cap. E12 laws of the federation of Nige­ria, 2004 and punishable under Section 60 of the same Act, These submis­sions were all contained in a Charge No FHC/AN/OR/88/016 dated 10th November, 2016. The State Coordinator of NESREA Niger State Field Office, Mr Ayuba Jacob, presented proof of evidence before the court that one Muhammad Na­dir Usman is a victim of noise pollution and then tendered documents marked as exhibits before the court. The case was filed on Wednesday 7th December, 2016 and was scheduled for hearing on 30th January, 2017.
