NERC transfers regulatory oversight of electricity market to OGERC

Nigerian Electricity Regulatory Commission (NERC) has issued a public notice on the transfer of regulatory oversight of the electricity market in Ogun State to the Ogun State Electricity Regulatory Commission (OGERC).

According to the notice on Monday, the transfer is in compliance with the amended Constitution of the Federal Republic of Nigeria (CFRN) and the Electricity Act 2023 (Amended).

It reads in parts; “the transfer is In compliance with the amended Constitution of the Federal Republic of Nigeria (CFRN) and the Electricity Act 2023 (Amended), the Nigerian Electricity Regulatory Commission (“NERC” or the “Commission”) has issued an order to transfer regulatory oversight of the electricity market in Ogun State from the Commission to the Ogun State Electricity Regulatory Commission (OGERC).”

It would be recalled that the Electricity Act of 2023 is a law that was adopted by the Nigerian Government on June 9, 2023 with the mandate of liberalising the electricity sector and promoting the use of renewable energy.

One of advantages of act is that it provides opportunity for state governments to have power in electricity transmission and distribution among others.

However, a licence is required for electricity generation, transmission, distribution, supply trading, and system operation.

Towards to, NERC on April 22, transferred regulatory role to Enugu Government which inn July 1, the commission also transferred regulatory power to the newly-created Imo State Electricity Regulatory Commission (ISERC).

The commission did same on August 6, 2024 to the Oyo State Government to OSERC and the Abia State Government respectively.
