Following a Supreme Court ruling that rejected a Stay of Executive files by Sen. Samuel Anyanwu, The Conference of Professionals in the Peoples Democratic Party (CP-PDP) has called on all members of the PDP to remain calm as they await the final verdict of the Supreme Court on the case of the National Secretary of our great Party.
The Conference in a statement on Monday by its pritem coordinator, Barr. Obinna Nwachukwu remarked that the Aoex Court on Monday, dismissed the application filed by Senator Samuel Anyanwu to Stay the Execution of the declaratory judgment of the Court of Appeal which on December 20, 2024, removed Senator Anyanwu and replaced with Hon. S.K.E Ude Okoye as the National Secretary of the PDP.
He said that “The dismissal of the Application by the Supreme Court has further elucidated and affirmed that a declaratory judgement of a Court of competent jurisdiction cannot be stayed under the Nigerian jurisprudence.
“The import of today’s outcome from the Supreme Court is that the December 20, 2024, judgment of the Court of Appeal which removed and replaced Senator Anyanwu with Hon. S.K.E Ude Okoye as the National Secretary of the PDP subsists.
“As a body of professionals, the Conference calls on Party members to remain law-abiding and guided by the spirit of sportsmanship as we join forces to strengthen and reposition our party for the task ahead”.
You may wish to note that Justice Musa Awani Aba-Aji dismissed the request when Kingsley Njemanze, a Senior Advocate of Nigeria, SAN, withdrew the request on behalf of his client.
The Federal High Court and the Court of Appeal in Enugu had in concurrent judgments removed Anyanwu as PDP National Secretary.
However, at Monday’s proceedings, Anyanwu backed down, urging the Supreme Court to allow him withdraw the bid to stop the execution of the judgments against.
Meanwhile, hearing in the substantive matter is going on before the five-man panel of justices headed by Justice Aba-Aji.
