A Federal High Court sitting in Kano, presided over by Justice A. M. Liman, has dismissed a case filed by Jafar Sani Bello, challenging the legality of Mohammed Sani Abacha’s membership of the Peoples Democratic Party (PDP).
Jafar Sani Bello is one of the governorship aspirants of PDP in Kano.
The same High Court had, last Thursday, affirmed Mohammed Abacha as the authentic PDP governorship candidate in Kano.
However, in an Originating Summon, Sani Bello alleged that Mohammed Abacha did not follow the procedure to register his membership of PDP at the Local Government and Ward levels, respectively.
But in his judgement through Zoom on Monday, Justice Liman disagreed with Jafar Sani Bello’s prayers.
Instead, he upheld that there was a waiver by the National leadership of PDP, stating that the respondent submitted the waiver to the court.
The presiding Judge, also stated that the National leadership of PDP gave waiver to every candidate who intended to register with the party and were allowed to contest for any position under the platform of the party.
He maintained that the particular waiver covered Mohammed Abacha to contest in any position under the party’s platform.
He also said the court agreed with the respondent’s submission that he was screened by the National leadership of PDP.
The court accordingly, dismissed the case of Jafar Sani Bello and affirmed that Mohammed Sani Abacha is legally a member of PDP.
The AUTHORITY recalls that the same Court, last Thursday, declared Mohammed Sani Abacha, son of the late Head of State, General Sani Abacha, as the duly elected gubernitorial candidate of the PDP in Kano State.
The Court presided over by Justice A.M Liman, nullified the primary election that gave the ticket to Sadik Aminu Wali, who before the judgement, had been recognized as PDP’s governorship flagbearer in the state.
The Court ordered the Independent National Electoral Commission (INEC) to, with immediate effect, recognize Mohammed Sani Abacha as PDP’s governorship candidate in Kano.
The Court, during the judgement which was virtually delivered at about 4 p. m Thursday, granted all the prayers of the plaintiff in the suit.
Mohammed Sani Abacha had dragged Sadiq Aminu Wali, PDP and INEC to a Federal High Court seeking his restoration and recognition as the Kano PDP governorship candidate in the 2023 election.
However, The AUTHORITY learnt that Sadiq Aminu Wali has appealed the judgement.
