Kano supplementary election: Doguwa floors Yusha’u, NNPP in Appeal Court

The Majority Leader of House of Representatives,  Hon. Alhassan Ado Doguwa has retained his victory in the supplementary election held in Doguwa/Tudun Wada Federal Constituency as Court of Appeal, Kano Division, on Friday, ruled that the Independent National Electoral Commission (INEC), has the right to conduct supplementary election in the constituency. 

The Appellate Court struck out an appeal filed by the New Nigeria Peoples Party (NNPP) and its candidate Air Commodore Salisu Yusha’u (rtd), restraining  INEC from conducting supplementary election in Doguwa/Tudun-Wada Federal Constituency.

The NNPP and its candidate, had also asked  the Court to withdraw the Certificate of Return already issued to Alhassan Ado Doguwa. 

But the Election Petition Tribunal had given  Doguwa victory, after which NNPP and its candidate appealed. 

However, delivering the judgement on Friday, Justice George Mbaba of the Appeal Court  upheld  the decision of the Tribunal. 

He struck out the Appeal by the NNPP and its candidate for lacking merit. 

Justice Mbaba also dismissed the NNPP and its candidate’s prayer, restraining  INEC from issuing a Certificate of Return to Alhassan Doguwa. 

The Court also ordered Salisu Yusha’u and NNPP to pay the respondents, (Alhassan Ado, and APC) the sum of N200,000 as a cost for filing a frivolous petition.

The AUTHORITY reports that the NNPP and its candidate, Air Commodore Salisu Yusha’u (rtd) had filed a petition at the National/State House of Assemblies Election Petition Tribunal sitting in Kano, challenging the declaration of Alhassan Ado Doguwa as the winner of the election by INEC.
